Dated 23.09.2026
The Court made the following:
ORDER:
The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), by the petitioner seeking pre-arrest bail in connection with Crime No.198 of 2026 of Tuni Rural Police Station, Kakinada District, registered in respect of a missing woman.
2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.
3. The learned Assistant Public Prosecutor submits that the petitioner has not yet been arraigned as an accused in the above crime. Hence, the apprehension expressed by the petitioner of his arrest is baseless.
4. As seen from the record, the petitioner has not yet been arraigned as an accused. Therefore, there is no imminent threat of his arrest at this stage. Hence, this Court is of the view that there are no grounds to grant pre-arrest bail to the petitioner at this stage. Accordingly, the Criminal Petition is dismissed, granting liberty to the petitioner to approach the learned Sessions Judge concerned, if he is subsequently arraigned as an accused and his arrest is apprehended.
5. In the result, the Criminal Petition is dismissed.
