The present miscellaneous application has been filed with the prayer for recalling/modification/restoration of order dated 19.09.2024 passed by this Court in S.B. Civil Writ Petition No.15319/2024. 2. Vide order dated 19.09.2024, the Court, while disposing of the writ petition, directed that if the respondents do not accept the cost and propose to contest/defend the writ petition and the [2026:RJ-JP:38204] (2 of 2) [WMAP-72/2025] said order, they shall be at liberty to get the writ petition restored and pray for recalling of the order. It is in pursuance to the said liberty that the present application has been filed. 3. However, Counsel for the petitioners, at the very inception, does not press the present application. He submits that the cost as deposited, be directed to be paid to the applicants as they are ready to accept the same now. 4. In view of the submission made, the misc. application is dismissed as not pressed. However, the cost as deposited by the petitioners of the writ petition, be released in favour of the applicants on the next date. 5. It is made clear that the learned Tribunal shall be under an obligation now to proceed further with the rent proceedings in accordance with order dated 19.09.2024. (REKHA BORANA),J 70/Arvind
