Heard Sri Saurabh Basu, Advocate appearing on behalf of the petitioner and learned Standing Counsel on behalf of the respondents. 2. The contention of the counsel for the petitioner is that eventually the petitioner was granted notional promotion from the date of promotion of his junior, i.e., 05.09.2016, vide order dated 06.04.2026; however, subsequently, a list was notified for sending the incumbents for training on 28.05.2026; but the petitioner's name does not find place in the said list. 3. The apprehension of the counsel for the petitioner is that in case he is not sent for training in the said list, he will be rendered junior and placed at the bottom of the list. 4. In view of the aforesaid, learned Standing Counsel submits that the petitioner has already made a representation on 04.05.2026 and the same shall be accorded consideration in accordance with law. However, this Court finds that an appropriate decision has to be taken by the competent authorities; therefore, the matter is only being remitted back to the authorities to consider the representation dated 04.05.2026, ensuring that the petitioner is not put in an inequitable position in view of the order dated 28.05.2026, and while passing the order, the observations of the Court shall be taken into account and a decision shall be taken expeditiously, preferably within a period of three weeks from the submission of the certified copy of this order.
