This petition is filed by wife for transfer of M.C.No.261/2025 filed by husband on 01.12.2025 before Family Court, Udupi. 5. It is stated that petitioner/wife is residing in Bengaluru in a rented house from April, 2024 and the marriage was performed in the year 2013 and they are blessed with a baby boy and now he is aged 4 years. The distance between Udupi and Bangalore is 410 kms. It seems that both of them went to USA. The petitioner returned along with the child and mother in July 2023. Respondent returned to India in July, 2024 after renewal of the H-1B visa. Petitioner stated that - 3 - HC-KAR NC: 2026:KHC:11868 CP No. 19 of 2026 respondent neglected her and not paid any maintenance. As such, she secured another employment and relocated to Bangalore and residing in a rented house. She expressed that she made her best efforts for reunion. Even husband also filed restitution of conjugal rights for reunion. However, as the petitioner is working in Bangalore and the distance between Bangalore and Udupi is 410 kms, it is inconvenient for her to travel with the child or by leaving her with the parents. This Court finds it reasonable to transfer MC No.261/2025 from Family Court, Udupi to Family Court Bangalore. However, as both parties are interested for reunion, the trial Court is directed to make efforts before the mediation center. Accordingly, civil petition is allowed.
