HIGH COURT OF JUDICATURE AT ALLAHABAD HABEAS CORPUS WRIT PETITION No. - 1085 of 2025 Court No. - 73 HON'BLE SANDEEP JAIN, J. By order dated 15.09.2026, the State as well as private respondents were directed to produce the corpus, Arti Sharma, before this Court. In compliance with the said order, she has been produced before the Court by SI Sandeep Kumar PNO No.234220595, Lady Constable Manu Sharma PNO No.252676190 and Constable Jatin Kumar PNO No.252679636, Police Station Mirzapur, District Shajahanpur. This Court interacted with the corpus, Arti Sharma, who disclosed that she had solemnized marriage with the petitioner, Aditya Kumar Sharma, on 07.05.2025. She further submitted that, subsequent to the marriage, she was subjected to cruelty and harassment in her matrimonial home and was frequently abused and assaulted by her husband. On account of the matrimonial discord, she does not want to reside with the petitioner in her matrimonial home. Upon being questioned about her present place of residence, the corpus stated that she is presently residing independently in Delhi and is earning her livelihood. She further stated that she is not residing in the company or under the control of any person against her wishes. It is, thus, apparent that there is matrimonial discord between the corpus and the petitioner, on account of which the corpus has left her matrimonial home and is presently residing independently in Delhi. It is further apparent that the corpus is not in the illegal detention of any person. Accordingly, the instant habeas corpus petition is dismissed. The corpus shall be at liberty to reside with any person of her choice and at any place of her choice, of her own free will.
