JUSTICE SANJAY KUMAR DWIVEDI For the Petitioner : Mr. Indrajit Sinha, Advocate Mr. Ajay Kumar Sah, Advocate For the State : Mr. Pankaj Kumar, P.P. For the Informant : Mr. Vishal Kumar Trivedi, Advocate Mr. Akash Kumar Tiwari, Advocate ------ 02/11.05.2026 Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Adityapur P.S. Case No. 67 of 2025, registered for the offence under Sections 316(2), 318(2), 338, 336(2) and 340(2) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Seraikella. 3. Learned counsel appearing for the petitioner by referring to the FIR submits that the informant appears to have dissatisfied with the petitioner’s act of selling of 15% of shares held by his Company, M/s Gleancore Minerals Private Limited to M/s Anantech Ventures Private Limited and not to the informant. He next submits that now his Company, M/s Gleancore Minerals Private Limited entered into a share purchase agreement dated 01.07.2024, whereby the parties agreed to the terms and conditions for sale of 15% of shares held by M/s Gleancore Minerals Private Limited in M/s Srija Steel and Power Industries Private Limited to the purchaser, M/s Anantech Ventures Private Limited. He further submits that in the agreement it has also been stated that for selling the share, first the same will be offered to the existing Directors. He submits that for a commercial transaction, criminal case has been lodged and even till date shares have not been transferred and in view of that no loss has occurred. 2026:JHHC:14211 4. Learned counsel appearing for the State and informant jointly oppose the prayer and submit that the allegations are there of selling the said share to another person not to the existing Directors. 5. Considering that the case is arising out of an agreement of selling of the shares and in the agreement it has been pointed out that both the sides have agreed to first offer the share to be sell to the existing Directors and it has been further pointed out that even the shares have not been transferred as yet and no loss has occurred and only the agreement has been entered into, prima facie it appears that for a commercial transaction, the FIR has been lodged, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Adityapur P.S.
