JUSTICE BALJINDER SINGH SANDHU Order 04/08/2026 01- The applicant-accused Shaitan Singh has filed following bail applications under Section 483 B.N.S.S. (439 Cr.P.C.) for releasing on bail :- Øe la[;k tekur vkosnu i= la[;k izFke lwpuk fjiksVZ la[;k iqfyl Fkkuk vijk/k vUrxZr /kkjk 01- 10073@2026 440@2019 ckluh] tks/kiqj 420] 406] 120ch Hkk-n-la- 02- 10076@2026 08@2020 nsouxj] tks/kiqj 420] 406] 409] 120ch Hkk-n-la- 03- 10101@2026 484@2019 egkeafnj] tks/kiqj 420] 406] 409] 120ch Hkk-n-la- [2026:RJ-JP:36626] (3 of 6) [CRLMB-10073/2026] 04- 10108@2026 290@2019 cksjkukMk] tks/kiqj 420] 406] 409] 120ch Hkk-n-la- 05- 10117@2026 187@2020 ekSyklj] ukxkSj 420] 406 Hkk-n-la- 02- The bail applications were heard and the available case records were examined. 03. On behalf of the applicant-accused, learned counsel submitted that the present matter arises from FIR No.32/2019, registered at Police Station SOG, Jaipur, concerning Sanjivani Credit Cooperative Society Ltd. It was argued that the SOG, Jaipur conducted a detailed investigation across the State of Rajasthan regarding the accounts, branches, and investments related to the said society, and thereafter filed a consolidated charge-sheet. In this case, the co-accused Devi Singh was granted bail by the Hon’ble Supreme Court in SLP (Cr.) No. 12198/2024, Devi Singh vs. State of Rajasthan & Anr.), vide order dated 17-12- 2024. While granting bail, the Hon’ble Supreme Court took into consideration that the applicant had been in judicial custody continuously since 19.09.2019, and imposed certain conditions. It is further submitted that, in compliance with the said order, there is no likelihood of the applicant absconding, nor any possibility of leaving the country. As per the directions, the applicant has also provided his mobile number to the SOG police authorities. 04. The present FIRs have been lodged by various persons who had invested in Sanjivani Credit Cooperative Society Ltd. It is stated that when their investments were not returned even after June 2019, complaints were filed by the investors. However, in the FIR No. 32/2019 registered by SOG, Jaipur, and in the charge- [2026:RJ-JP:36626] (4 of 6) [CRLMB-10073/2026] sheet submitted therein, it has been stated that the applicant- accused served as Chairman of Sanjivani Credit Cooperative Society Ltd. from 13.05.2014 to 12.06.2016. It has been argued on behalf of the applicant-accused that he was merely an employee of co-accused Vikram Singh, and was appointed by him as Chairman. As per the charge-sheet filed by SOG, the applicant- accused was not a member of the loan committee and has not committed any irregularity. It is further submitted that the applicant-accused did not cause any financial loss to the society. He has been implicated only on the basis of holding the position of Chairman between 2014 and 2016. 05. It is submitted that in the main case, the Hon’ble Supreme Court has already granted bail. Therefore, involving the petitioner in subsequent cases on the ground of non-refund of investors’ money is unjustified and not legally sustainable. The applicant- accused has been arrested in various cases filed by investors and produced before the court. Out of these, in 20 cases, Coordinate Benches of this Court at Jaipur have already granted bail to the present petitioner in CRLMB Nos.8624/2026, 8646/2026, 8647/2026, 8648/2026 and 8649/2026 vide order dated 22.07.2026, in CRLMB Nos.5897/2026 along with nine other connected bail applications on 08.07.2026, in CRLMB Nos.5912/2026, 5905/2026 and 5885/2026 vide order dated 30.06.2026 and this Court in CRLMB Nos.10074/2026 and 10104/2026 vide order dated 03.08.2026. [2026:RJ-JP:36626] (5 of 6) [CRLMB-10073/2026] 06. It is stated that in the present bail applications the trial is likely to take considerable long time and it is prayed that the applicant-petitioner be released on bail in all these matters. The custody of the petitioner in the present bail applications is as under: • Bail Application No. 10073/2026 – since 03.03.2021 • Bail Application No. 10076/2026 – since 04.03.2021 • Bail Application No. 10101/2026 – since 20.06.2024 • Bail Application No. 10108/2026 – since 05.03.2021 • Bail Application No. 10117/2026 – since 24.06.2021 07. On the other hand, the learned Public Prosecutor opposed the bail applications and prayed for their rejection. 08. I have considered the submissions made and perused the record. The Coordinate Bench of this Court has already considered the matter vide orders dated 22.07.2026 and 08.07.2026. Charge-sheets have already been filed in these cases, and the trial is likely to take time. In FIR No. 32/2019 registered by SOG, Jaipur, the charge-sheet dated 11.12.2019 was filed after detailed investigation, which has been taken into consideration. As per the same, the applicant-accused was Chairman of Sanjivani Credit Cooperative Society Ltd. from 13.05.2014 to 12.06.2016. The list of members of the loan committee, as recorded in the SOG charge-sheet, does not include the applicant-accused, indicating that he was not a member of the loan committee. It is also noted that the applicant-accused has been in judicial custody for a considerable period. In similar nature of cases, the Coordinate [2026:RJ-JP:36626] (6 of 6) [CRLMB-10073/2026] Bench has already granted bail in 17 cases vide order dated 22.07.2026, 08.07.2026 and 30.06.2026. Additionally, in FIR No. 32/2019 registered by SOG, Jaipur, bail has already been granted as per order dated 30.01.2026. 9. Therefore, without commenting on the merits of the case, and considering the overall facts and circumstances, it appears just and proper to grant the benefit of bail to the applicant- accused. 11. Resultantly, the bail applications filed on behalf of the applicant-accused are allowed. It is ordered that the accused- petitioner Shaitan Singh S/o Uttam Singh, arrested in connection with aforesaid FIR shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
