02/06.05.2026 Heard Mr. Manish Yadav, learned counsel for the petitioner and learned A.P.P. for the State. This application is directed against the order dated 28.11.2025 passed by the learned Special Judge, Child Act Cases-cum-Additional Sessions Judge-I, Chatra in connection with Criminal (Juvenile) Appeal No. 75/2026 dated 16.12.2025, whereby and whereunder, the order dated 28.11.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Chatra in MCA No. 3633/2025, arising out of Sadar P.S. Case No. 261/2025 rejecting the prayer for bail of the petitioner has been affirmed. Submission has been advanced by the learned counsel for the petitioner that the petitioner is in Observation Home since 16.10.2025. It has further been submitted that though there is another case instituted against the petitioner being Lawalong P.S. Case No. 53/2025 the petitioner is on bail in the said case. It has also been submitted that the petitioner was not named in the First Information Report but has been implicated on the confession of a co-accused. Learned A.P.P. has opposed the prayer for bail made in this application. Regard being had to the manner of implication of the petitioner and the fact that he is in Observation Home since16.10.2025, while setting aside the order dated order 16.12.2025 passed by the learned Special Judge, Child Act Cases-cum-Additional Sessions Judge-I, Chatra in Criminal (Juvenile) Appeal No. 75/2026, and the order dated 28.11.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Chatra in MCA No. 3633/2025, arising out of Sadar P.S. Case No. 261/2025, the petitioner is directed to be released on bail on furnishing bail bond of Rs.
10,000/- (Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Chatra in connection with Sadar P.S. Case No. 261/2025, subject to the condition that one of the bailer should be the father of the petitioner who shall take care of the well-being of the petitioner and shall also ensure that the petitioner is kept away from anti- social elements.
