WITH THE PETITIONER 1 AND 2 NAME RECORDED AS HER ADOPTIVE PARENTS, IN CO-ORDINATION WITH ALL OTHER RESPONDENTS WITH THE PETITIONERS RECORDED AS HER ADOPTIVE FATHER AND MOTHER, IN CONFORMITY WITH THE REGISTERED ADOPTION DEED, BIRTH CERTIFICATE, AND AADHAAR CARD AND ETC. THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM - 3 - HC-KAR NC: 2026:KHC:17067 WP No. 28902 of 2025 ORAL ORDER The present petition is instituted by petitioner Nos.1 and 2, who are the parents of petitioner No.3, a minor child, seeking issuance of a writ in the nature of mandamus directing respondent No.4 to issue a Transfer Certificate in respect of petitioner No.3 reflecting her name as “Dheemahi S.R.” and recording petitioner Nos.1 and 2 as her adoptive parents. The grievance of the petitioners is that, despite submission of a representation, respondent No.4 has failed to take necessary action, thereby compelling the petitioners to approach this Court. 2. In order to substantiate the claim of lawful adoption of petitioner No.3, the petitioners have produced along with the petition a true copy of the registered adoption deed, the birth certificate, and the Aadhaar card of the minor child. - 4 - HC-KAR NC: 2026:KHC:17067 WP No. 28902 of 2025 3. Upon perusal of the material placed on record, particularly the adoption deed, this Court is of the considered opinion that once a child is lawfully adopted in accordance with law, and the adoptive parents have submitted a representation seeking correction of school records, the concerned school authorities are under an obligation to reflect the correct particulars of the adoptive parents in the official records. In the present case, there is evident inaction on the part of respondent No.4. Hence, this Court deems it appropriate to issue necessary directions to respondent No.3 to communicate with respondent No.4 to consider the representation submitted by petitioner Nos.1 and 2 for rectification of the Transfer Certificate. 4. In the result, the following order is passed: ORDER (i) The writ petition is hereby allowed; - 5 - HC-KAR NC: 2026:KHC:17067 WP No. 28902 of 2025 (ii) Respondent No.3 is directed to forthwith issue a communication to respondent No.4 to consider the representation submitted by petitioner Nos.1 and 2, produced at Annexure- D, and to record the names of the adoptive parents in the school records by taking cognizance of the registered adoption deed produced at Annexure-A; (iii) The aforesaid exercise shall be completed by respondent No.3 within a period of four (4) weeks from the date of receipt of a copy of this order; (iv) Upon receipt of such communication from respondent No.3, respondent No.4 shall, without delay, carry out necessary corrections in the school records and issue a fresh Transfer Certificate reflecting the names of the adoptive parents. The said exercise shall be completed within a further period of four (4) weeks thereafter. SD/- (SACHIN SHANKAR MAGADUM) JUDGE CA List No.: 1 Sl No.: 37
