1. Supplementary affidavit on behalf of the applicant, filed today in Court, is taken on the record. 2. Heard Learned counsel for the applicant; and Learned A.G.A. for the State. 3. The present anticipatory bail application has been filed on behalf of the applicant in Case Crime No. 0409 of 2026, under Sections 85, 115(2), 123 and 351(3) of the B.N.S., 2023 and Sections 3/4 of the Dowry Prohibition Act, Police Station – Jahangirabad, District Bulandshahar, with a prayer to enlarge her on anticipatory bail, as the applicant apprehends her arrest in the aforesaid case. 4. Learned counsel for the applicant has contended that the applicant is a lady and the mother-in-law of the alleged victim. The allegation is of the applicant and the co-accused demanding additional dowry and for non- fulfillment thereof meeting out harassment and torture to the victim. The allegation further is that on 27.07.2026 at about 9 P.M., the applicant supposedly hit the victim on the head with a brick while she was feeding her child and made her forcibly drink poison. The Learned counsel has further submitted that the victim was medically examined and no head injury has been noted in the said medical examination. 5. The Learned A.G.A. has opposed the prayer for bail and has contended that there are specific allegations against the applicant of feeding the victim poison alongwith the co-accused after hitting her on the head with Versus Counsel for Applicant(s) : Ram Krishna Mishra Counsel for Opposite Party(s) : G.A., Kuldeep Singh, Shriyansh Singh Smt. Munni Devi .....Applicant(s) State of U.P. .....Opposite Party(s)
a brick. The Learned A.G.A. has stated that the applicant has no criminal antecedents. 6. I have considered the submissions made by the Learned counsel for the parties. 7. The First Information Report (FIR) is delayed by three days. From the perusal of the medical examination report of Vedanta Hospital, which is available in the case diary, no dimensions of the said head injury inflicted by the applicant have been mentioned. The version as given in the FIR was of the applicant hitting the victim on the head and then the applicant and the co-accused, the husband of the victim, forcefully feeding her poison.
There doesn't appear to be any external injury present on the victim and the medial report only speaks of the injuries but there is no observation of the doctor regarding the injuries being present on the injured. Head injury is listed as one of the chief complaints in the medical report. 8. On a pointed query made to the Learned A.G.A. as to whether apart from the report of Vedanta Hospital there is any other medical report available, the Learned A.G.A. states that except the medical report of Vedanta Hospital there is no other medical report available on record. 9. Taking into consideration the entire facts and circumstances of the case, as discussed above, I deem it appropriate to enlarge the applicant on anticipatory bail. 10. The anticipatory bail application of the applicant is allowed. 11. In the event of the arrest of the applicant- Smt.
