1. Petitioner, through the medium of this petition, invoking supervisory jurisdiction of this Court vested under Section 529 of BNSS, seeks direction upon the Court of learned Judicial Magistrate (2nd Additional Munsiff), Srinagar, to dispose of the complaint titled “Shahnaza Begum & Ors. Vs. Syed Reyaz Shah”, filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005.
2. Learned counsel for the petitioner submits that the complaint has been sub-judice before the court below since 05.06.2023 and its trial has not been concluded till date, though summary proceedings are to be carried out under the Provisions of the DV Act.
3. In view of the pleadings and the submission urged at the Bar, no useful purpose would be served by keeping this petition on board for further adjudication, having regard to the limited nature of relief sought.
4. Accordingly, the present petition is disposed of, at this motion stage, with a direction to the court below to proceed with the matter expeditiously and make an endeavour to dispose of the case within a period of eight weeks from this date.
5. A copy of this order shall be forwarded to the Trial Court, for information and record.
6. The petition is thus, disposed of, along with application(s), in the above terms.
