Petitioners contend that they were prevented from joining service during the said period on account of the interim order passed in O.A.No.9766 of 2011 and batch, dated 23.12.2011, and that the failure of Respondents to extend the aforesaid benefit is highly arbitrary and illegal. 3) Learned Assistant Government Pleader along with counter- affidavit placed on record various proceedings, including the Proceedings in Lr.Rc.No.10/OP.I/2025, dated 24.01.2025, wherein 13 Director of Collegiate Education submitted a proposal to the Government, explaining the circumstances leading to the delayed joining of Petitioners on account of the pendency of the Court cases, and recommended extension of the benefit of “Compulsory Wait” to 90 candidates, in the interest of fairness and in accordance with the applicable Service Rules. It is stated that the said recommendation is presently pending consideration before the Government. 4) Learned Counsel for Petitioners also placed reliance on G.O.Rt.No.88, Higher Education (CE-I-1) Department, dated 06.02.2013, wherein the cases of certain similarly situated Lecturers were considered and the intervening period was treated as a period of “Compulsory Wait”, with the same date of joining being assigned to them on par with the other candidates selected pursuant to the said selection process. Learned Counsel, therefore, seeks a direction to Respondents to consider the case of Petitioners also, in the light of the recommendations submitted by Director of Collegiate Education, dated 24.01.2025, and extend the benefit of “Compulsory Wait” to Petitioners on par with the similarly situated candidates. 5) It is also brought to the notice of this Court that the High Court for the State of Telangana, in W.P.Nos.2571 and 5455 of 2018, considered the cases of similarly situated employees, taking into consideration G.O.Rt.No.88, dated 06.02.2013, and extended the 14 benefit of treating the intervening period as “Compulsory Wait”, thereby assigning the same date of joining to Petitioners therein on par with the other similarly situated candidates. 6) Considering the submissions made by the learned Counsel appearing on either side, this Court deems it appropriate to direct 1st Respondent to consider the case of Petitioners, in the light of the recommendations of Director of Collegiate Education, dated 24.01.2025, and pass appropriate orders, in accordance with law, within a period of two (02) months from the date of receipt of a copy of this Order. 7) With the above direction, the Writ Petitions are disposed of. 8) No order as to costs.
