ORDER Date : 07-08-2026 Heard Mr. R. Koyu, learned counsel for the applicant. Also heard Ms. L. Hage, learned Additional Public Prosecutor for the State and Mr. M. Khambo,
learned counsel for the respondent No. 2.
2. In the main petition, i.e., Crl. Petn. No. 188/2023, a Coordinate Bench of this Court, vide order dated 04.09.2024, was pleased to stay the further proceedings of Sessions Case No. 1/2024 pending before the learned Sessions Judge, Yupia. The interim order was initially passed till the returnable date and has, thereafter, been extended from time to time.
3. The applicant, who is respondent No. 2 in the connected criminal petition and the informant of the case, submits that he is being prejudiced by the stay of the proceedings in Sessions Case No. 1/2024 and has, therefore, filed the present interlocutory application seeking vacation of the aforesaid order of stay dated 04.09.2024.
4. The scanned copy of the Trial Court Record has already been received.
5. Learned counsel appearing for both sides have mutually agreed that they would seek disposal of the main petition, which is stated to be already fixed for hearing on 12.08.2026.
6. Accordingly, this interlocutory application may also be tagged with Crl. Petn. No. 188/2023 and posted for listed on 12.08.2026.
7. It is observed that, if for any reason the there is delay in disposing of the
