Mr. I. Bam, learned counsel appearing on behalf of Mr. C. Modi, learned counsel for the petitioner submits that in terms of the recommendation made for appointment of the respondent No. 5, as Gaon Burah of Kiyit village, which is under challenge in the present writ petition, the competent authority has acted, thereon, and has appointed the said respondent No. 4 as Gaon Burah of the said village. He submits that the appointment
order would now also required to be assailed. The learned counsel for the petitioner, accordingly, submits that he be permitted to withdraw the present writ petition with liberty to re-file the same by also assailing the appointment of the respondent No. 5, herein, as the Gaon Burah of the said village. The prayer is not objected to by Ms. R. Basar, learned Government Advocate, Arunachal Pradesh, appearing for the State respondents. Accordingly, the present writ petition stands dismissed on withdrawal, with liberty as prayed for.
