The brief facts of the case are that the petitioner is a minor child aged about 13 years was admitted at the entry level under the DG category in respondent No. 3 school. 4. The child has been studying continuously in respondent No. 3 upto class 8th. However, on qualifying for class 9th it is stated that respondent No. 3 has refused to continue the child’s education unless regular full fee is paid, hence the present petition. 5. Ms. Mendiratta, states that even though the issue regarding the right of the petitioner to continue beyond class 8th is sub-judice before the Division Bench, without prejudice to the rights and contentions of the parties the petitioner’s child will be permitted to continue her studies in respondent No. 3 school under the DG category till the matter is finally adjudicated by the Division Bench. 6. She further states that the concession is only in the peculiar facts of the present case and the concession given does not amount to respondent no. 3 agreeing to the applicability of The Right of Children to Free and Compulsory Education Act, 2009 upon respondent No. 3. 7. The same is disputed by Mr. Rohatgi, learned Standing Counsel. 8. However, in view of the concession the issue is left open to be decided in appropriate manner. 9. In view of the above nothing survives for the adjudication by this Court. 10. The petition is disposed of in aforesaid terms. JASMEET SINGH, J JULY 3, 2026/JK This is a digitally signed order.
