Be that as it may, all the aforesaid aspects would, in any event, fall for consideration and examination by the concerned Court in accordance with law during the course of trial. 5. The Court, however, finds that, by a detailed order passed in the case of Prashant v. State Govt. of NCT of Delhi1, this Court has already considered the facts and circumstances of the case and observed that the present applicant, along with the co-accused, Prashant Chaudhary, had assisted the main accused in the commission of the offence in question. 6. Bearing in mind the findings and reasons already recorded in Prashant v. State (Supra), this Court is of the considered view that the present applicant is also entitled to the grant of regular bail. It is pertinent to note that the applicant has been in custody since 2022 and has already undergone incarceration for about four and a half years. Of the 40 prosecution witnesses cited, only nine have been examined thus far. The delay in the conduct of the trial is not attributable to the present applicant, and the trial, in any event, is likely to take considerable time to conclude. 7. Accordingly, the applicant is directed to be released on regular bail, subject to the conditions to be imposed by the concerned trial Court. 8. Application stands disposed of.
