JUSTICE SOUMITRA SAIKIA JUDGEMENT 17.08. 2026 Heard Mrs. Caroline K Lungawipuii learned counsel for the petitioner/ applicant. Also heard Ms. Ruth Lalruatfeli learned counsel for the respondents. This Interlocutory Application has been filed by the applicant, who was Page No.# 2/3 the appellant in MAC. App. No. 8/2025. By the said application, a direction was sought for release of Rs. 25,000/-(Rupees Twenty Five Thousand Only), which was deposited by the appellant as a statutory deposit while filing the connected appeal, being MAC App. No. 8/2025. It is submitted that by judgment and order dated 12.02.2026, the appeal was dismissed and the judgment and award passed by the Motor Accident Claims Tribunal (MACT), Aizwal, in MACT Case No. 38/2022 was upheld. The learned counsel for the applicant submits that the compensation amount has already been released on the basis of instructions received and the statutory deposit has not been adjusted. The learned counsel appearing for the respondents, on the other hand, acknowledges receipt of the compensation amount in full. In that view of the matter, there is no dispute that the compensation amount has been released pursuant to the dismissal of the MAC Appeal, whereby the judgment and award dated 14.02.2025, passed by the Motor Accident Claim Tribunal (MACT), Aizwal in MACT Case No. 38/2022 was upheld. However, while dismissing the said MAC Appeal, no order was passed permitting the withdrawal of statutory deposit made by the appellant at the time of filing the MAC Appeal. Accordingly, this Interlocutory Application stands allowed. The Registry will refund the Statutory deposit of Rs. 25,000/-(Rupees Page No.# 3/3 Twenty Five Thousand only) without any interest, to the applicant/ appellant upon furnishing adequate documents regarding identity of the competent officer duly authorized and the particulars of the bank account to which the amount is to be released. Accordingly, this Interlocutory Application stands disposed of. JUDGE JUDGE Comparing Assistant
