Mr. Rajesh Kosh, Advocate, for respondent No.2. In view of the averments made in the application, which is supported by an affidavit of the official, delay of 135 days in filing the appeal is condoned. Accordingly, the application stands disposed of. LPA No. of 2026 Appeal be registered. Inter alia contends that the reliance has been placed upon the judgment passed in CWP No.6688 of 2021, titled Bimla Devi Vs. State of HP and Ors., decided on 27.06.2025. It is submitted that LPA No.128 of 2026, titled State of HP and Ors. Vs. Bimla Devi and Another, has been preferred against the judgment dated 27.06.2026 and interim order dated 24.04.2026 as such has been passed, staying the operation and execution of the judgment passed by the learned Single Judge in Bimla Devi’s case. Accordingly, it is submitted that the benefit of whole time contingent services are not liable to be granted for the purposes of counting pensionary benefits and to be treated towards the qualifying service, keeping in view Rules 2(b) & 2(c) of the CCS Pension Rules, 1972. On taking steps within three days, issue notice to respondent No.1, returnable on or before the next date of hearing. List on 29.06.2026. Interim order in the same terms.
