The Petitioner contends that he is carrying out repair of the existing boundary wall and proposes to raise the same within the permissible limits. The said petition came to be dismissed as withdrawn on 31st July, 2024, in the following terms: “1. This writ petition has been preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking directions to the Respondents not to obstruct and interfere in the construction work of boundary wall around the subject land owned by the Petitioner, 2. After canvassing some arguments, leamed counsel for the Petitioner, on instructions, seeks to withdraw the present petition. 3. The writ petition is dismissed as withdrawn. Pending application also stands disposed of.” 3. It is also noted, that apart from the aforenoted order, there is also a restraining order passed by the SDM on 07th February, 2023 on the basis of a report submitted by the field staff of the Revenue Department alleging that unauthorized construction was being carried out on the land in question. The said restraining order admittedly continues to remain in force. The Petitioner, however, disputes the aforesaid allegation and places reliance upon the reply to an RTI application to contend that no unauthorized construction was found on the portion of land in his possession. 4. In the opinion of the Court, so long as the aforesaid restraining order remains operative, instant petition cannot be entertained. The Petitioner ought to first approach the concerned SDM. He shall be at liberty to submit an appropriate representation in this regard explaining the nature and extent of the work proposed to be carried out. Upon receipt of such representation, the SDM shall consider the same, undertake due verification of the site, if considered necessary, and pass an appropriate order in accordance with law. Counsel for the Petitioner states that such a representation will be submitted within a period of one week from today. If such representation is filed, the SDM is requested to consider and decide the same within a period of six This is a digitally signed order.
