11.03.2026 Court No.28 Item No.30 ssi CRM (A) 547 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Kaliachak Police Station Case No. 1073 of 2025 dated 18.06.2025 under Sections 21 ( c)/25/27A/29 of the NDPS Act. And In the matter of: Md. Kabirul Sk @ Md Kabirul Sekh @ Kabirul. …. Petitioner Mr. Tapodip Gupta Mr. Golam Ahammed …for the petitioner Mr. Sanjay Bardhan Mr. Samarjit Balial …for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the only material available against the present petitioner is the statement of the co-accused, which is not admissible in evidence. Learned counsel appearing on behalf of the State relies on the report and the case diary and opposes the prayer for anticipatory bail. He submits that, other than the materials available in the case diary, there are phone call records between the petitioner and the co- accused. A proclamation has already been issued against the present petitioner. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail. 2 Accordingly, the application for anticipatory bail of the petitioner is rejected.
