The present contempt application has been preferred alleging willful defiance of the order dated 17.11.2025 passed in Writ-C No. 39987 of 2025, order whereof is quoted hereinunder:- "1. Learned counsel for the petitioner submits that subject matter of this petition and the related claim is already pending consideration before the Sub Divisional Magistrate, Tehsil Handia, Prayagraj and the same is yet to be decided. 2. Under the circumstances, the petition is disposed of with a request to the said respondent to decide the above-mentioned representation dated 4.10.2025 and take appropriate action, as provided under the law, if deemed essential, within a period of eight weeks from the date on which the certified copy of this order is placed before him." 2. Today, when the matter has been taken up, the order dated 30.09.2026 has been produced, according to which, the representation has been decided. 3. Though the learned counsel for the applicant has sought to argue on merits but the Court is not required to delve into the merits particularly when the remedy lies elsewhere. 4. In view of the above, the present contempt application is consigned to record leaving it open to the applicant to approach the appropriate forum as and when occasion arises.
