JUSTICE SOUMITRA SAIKIA JUDGEMENT 24.08.2026 Heard Mr. Lalrokunga Pautu, learned counsel for the applicant. Also heard Ms,. Zairemsangpuii, learned counsel for the respondent No. 1; Mr. Samuel V. Chhangte, learned counsel for the respondents No. 2 to 4 and Mrs. C.K. Lungawipuii, learned counsel for the respondent No. 5. This interlocutory applicant has been filed seeking impleadment of Secretary, Land Revenue & Settlement Department, Government of Mizoram as respondent No. 7 in the W.P(C) No. 49/2025. The claim in the accompanying writ petition is for payment compensation to the petitioners on the encroachment of their landed property at Dulte Village. The petitioners/applicants claimed to be the land owners within the stretch of land from 54.6 Km to 69.015 Km at the Dulte Village along the Khawzawl to Dulte Page No.# 5/5 Road and their landed property was encroached for constructions of road by the respondent authorities. Under such circumstances, the writ petition has been filed. It is submitted by the learned counsel for the applicants/writ petitioners that the Secretary, Land Revenue & Settlement Department, Government of Mizoram is the appropriate department for land administration, allotment and resolutions of the revenue settlement discrepancies within the State of Mizoram and therefore, the said department is a necessary party without which effective orders could not be passed in the writ petition. The respondents represented by the Government Counsel does not object to the prayer made. Under such circumstances, at this stage without issuing notice, the Interlocutory Application stands allowed. The Secretary, Land Revenue & Settlement Department, Government. of Mizoram, MINECO, Khatla, Aizawl, Mizoram PIN 796001 is arrayed as respondent No. 7 in the W.P(C) No. 49/2025.
