1 26-27-Cr.BA-1085-1086-2026 IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH, NAGPUR. CRIMINAL APPLICATION [B.A.] NOs. 1085 & 1086 OF 2026 Anu Rajan Acharya -- VERSUS -- State of Maharashtra and Another __________________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's orders. and Registrar's Orders. Mr. N. Padia, Advocate for the Applicant. Mr. N.B. Jawade, A.P.P. for the Non-applicant No.1/State. Ms. Nikita R. Shahu, Advocate for the Non-applicant No.2. CORAM : M.M. NERLIKAR, J. DATE : SEPTEMBER 28, 2026. COMMON ORDER Heard. 2. The learned counsel for the applicant presses the present applications on the ground of “delay in trial”, since the applicant is in jail for the last five years and five months. He submits that, though the allegations against the applicant are serious in nature, however, considering the long incarceration, the applicant deserves to be released on bail, as the trial is not going to conclude in near future. 3. On the other hand, the learned A.P.P. submits that, no doubt, the applicant is in jail for the Piyush Mahajan 2026:BHC-NAG:12802 2 26-27-Cr.BA-1085-1086-2026 last five years and five months, however, considering the seriousness of the allegations, the applicant does not deserve to be released on bail. Upon query being made to learned A.P.P. as to when the evidence of the victims will be concluded, learned A.P.P., on instructions, makes statement, it will be completed within 2 months. 4. Considering the statement made by the learned A.P.P. that the evidence of both the victims would be concluded within 2 months, learned counsel for the applicant seeks permission to withdraw the present application, with liberty to approach this Court once again after completion of the evidence of both the victims or after two months which ever is earlier raising the ground of “delay in trial.” 5. Permission granted. The Criminal Application is disposed of as withdrawn, with liberty as prayed for. [ M.M.
