Heard Mrs. Kumari Rashmi, learned counsel appearing on behalf of the opposite party- State of Jharkhand. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 27.04.2025 in connection with Deori P.S. Case No. 38 of 2025 corresponding to POCSO Case No. 80 of 2025, registered under Sections 127(2) /65(2)/62 of the B.N.S. and Sections 8 and 10 of the POCSO Act, now pending in the court of learned Special Judge POCSO Act, Giridih. 4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is in custody since 27.04.2025. He has submitted that no witness has been examined. Learned counsel submits that there is land dispute and there is delay in lodging the F.I.R. by four days. 5. The learned counsel for the State has opposed the prayer for bail and has submitted that the allegations are serious and the alleged offence has been committed by elder family member of the family and the two minor victims have also supported the allegations in the statement recorded under Section 183 of B.N.S.S. 6. Learned counsel has submitted that the state would ensure production of witness. 7. Considering the seriousness of the nature of allegations supported by the recorded statement of the victims as mentioned above, this court is not inclined to enlarge the petitioner on bail. 2 Accordingly, prayer for bail of the petitioner is rejected. 8. However, the State is directed to ensure prompt production of witness before the court. 9. The learned counsel of the State is directed to forward a copy of this order to the concerned authority for compliance. 10. Let this order be communicated to the court concerned through FAX.
