By virtue of the present application, petitioner seeks modification of paragraph no.3 of the order dated 03.06.2026. 4. For the reasons stated in the present application, the same is allowed and paragraph no.3 of the order dated 03.06.2026 passed by this Court is modified to read as under: “3. By the virtue of the present petition under Article 226 of the Constitution of India, the petitioner seeks the following reliefs:- This is a digitally signed order. Issue an appropriate writ of Mandamus, Certiorari or any other appropriate writ, order or direction thereby staying/ suspending the operation, implementation and further proceedings pursuant to the impugned Agenda Notice/ Election Programme dated 20.05.2026 issued by Respondent No.4 for conducting election of the Managing Committee of Jaina Cooperative Group Housing Society Ltd., during the pendency of the present writ petition and/or till adjudication of the pending Arbitration/ Dispute Petition dated 15.05.2026 filed before the Registrar Cooperative Societies; b) Issue an appropriate writ of Mandamus or any other appropriate writ, order or direction directing Respondent Nos.4 to reconstruct, verify and maintain the statutory Register of Members strictly in accordance with Section 48 of the Delhi Cooperative Societies Act, 2003 read with Rule 28 of the Delhi Cooperative Societies Rules, 2007 after considering objections/claims of members and after permitting inspection and verification of statutory records to the members concerned; c) Issue an appropriate writ of Mandamus or any other appropriate writ, order or direction directing Respondent Nos.2 and 3 to forthwith list, hear and decide the pending Arbitration/Dispute Petition dated 15.05.2026 and applications filed therein in a time-bound manner before proceeding further with the election process of Respondent No.4 Society; d) Issue an appropriate writ, order or direction thereby restraining the Respondents from conducting election of the Managing Committee of Respondent No.4 Society on the basis of disputed, unauthenticated and unverified membership list/electoral roll pending reconstruction and verification of the statutory Register of Members in accordance with law; e) Pass any such other or further order(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances This is a digitally signed order.
