In the present writ petition a challenge is raised to the communication dated 30.07.2025 issued by the Education Officer (Secondary), Zilla Parishad, Wardha, informing the Head Masters of four Schools, run by the Trust namely Saraswati Mata Vidya Prasarak Mandal, Thanegaon, Tq. Karanja, District Wardha, to be managed by the trustees on Schedule-1 of the Trust. 2. There appears to be faction in the Trust and therefore, the Education Officer directed the trustees on Schedule-1 to manage the Trust. 3. On a specific query put to the Education Officer through the Assistant Government Pleader to show the source of power of the Education Officer to decide who should administer and manage the Trust, the learned Assistant Government Pleader could not answer the query. 4. Thus, it is evident that the Education Officer has exceeded its jurisdiction by issuing directions to the Head Masters of the four Schools run by Saraswati Mata Vidya Prasarak Mandal, Thanegaon, Tq. Karanja, District Wardha, to be managed by the trustees on Schedule-1 of the Trust. 2026:BHC-NAG:12779-DB 23-WP-4571-2025.odt 2 5. It is to be noted that this Court in Writ Petition No. 6208 of 2024 has set aside the communication dated 02.08.2024 issued by the same Education Officer directing the President/Secretary of the Trust not to take any policy decision. The said order was also found to be without jurisdiction. 6. In the circumstances, as there is no authority to the Education Officer (Secondary), Zilla Parishad, Wardha, to ask the Head Masters to run and manage the Schools by the trustees on the Schedule-1, we allow the writ petition thereby quash and set aside the impugned communication issued on 30.07.2025 issued by the Education Officer (Secondary), Zilla Parishad, Wardha. 7.
