Heard the parties. 2. The petitioner, in this petition, has prayed for the following reliefs:- “A. For issuance of an appropriate writ(s), order(s) and and/or direction(s), particularly a writ in the nature of Certiorari for quashing the Office Order No.-06 dated 21/01/2026 as contained in Memo No.48 dated 21/01/2026 (Annexure-2) issued under the signature of Managing Director, Jharkhand State Agricultural Marketing Board, Ranchi, by which the petitioner has been deputed on the post of Marketing Supervisor, Jharkhand State Agricultural Marketing Board, Ranchi completely ignoring the fact that the petitioner was already working on higher post of Marketing Supervisor- cum-Marketing Secretary, Agriculture Produce Market Committee, Ranchi, which is a junior post than what the petitioner is holding at present that to behind his back as at the time issuance of the Deputation Order the petitioner was on Seek Leave, wholly on the baseless ground and without jurisdiction as because as per the Notification of the Agriculture, Animal Husbandry and Co- 2026:JHHC:4776 2 operative Department (Agriculture Department), Government of Jharkhand as contained in Letter No.- 3376 dated 29/09/2023 (Annexure-4), transfer/deputation can be done only in the month of June-July after the recommendation of the Establishment Committee under the supervision of Managing Director and before passing of the transfer order, the approval of the Chairman, Marketing Council is must and also in special circumstances/ administrative reason only after getting the prior approval of the Departmental, the Chairman, Marketing Council can pass order of transfer/posting. B. For issuance of direction staying the operation/implementation of the order dated 21.01.2026 during the pendency of the instant Writ petition. AND/ Or The petitioner further prays for issuance of any other appropriate writ(s), Order(s), Directions(s) for which the petitioner be found entitled to in the facts and circumstances of the case.” 3. From the aforesaid prayer, it is clear that the petitioner has approached this Court for quashing Annexure-2 to this writ petition and praying stay of the said order. 4. During course of argument, Mrs. Ritu Kumar, learned counsel fairly admits that the Chairman of the Marketing Board has stayed Annexure-2 vide Annexure-5. 5. Since, the Annexure-2, which the petitioner is challenging, has been stayed, this Court fails to understand as to why the writ petition has been filed by the petitioner in spite of the fact that Annexure-5 by which Annxure-2 has been stayed, was within the knowledge of this petitioner.
