This bail application has been filed on behalf of Binay Kumar Sharma who is in custody since 17.09.2025 in connection with Golmuri P.S. Case No. 05 of 2022 for the offence registered under Sections 406 and 420 of the IPC pending in the Court of learned Judicial Magistrate 1st Class, Jamshedpur, is pressed into motion. As per the FIR, petitioner was serving as an accountant in Reliance Fresh Store and committed criminal breach of trust of Rs.8,79,657.50/-. The sale receipts which were collected by him, was not deposited. It is submitted by the learned counsel on behalf of petitioner that there is no documentary evidence to show that he was working there as an accountant and further there is no material to substantiate the allegation of misappropriation committed by him. Learned A.P.P. for the State opposed the prayer for bail and submitted that in para-101 of case diary there is an audit report which shows criminal breach of trust having been committed by this petitioner. Having considered the submissions advanced, it appears that charge sheet has been submitted under Section 406 and 420 of the IPC. Under the circumstances, the above-named petitioner is directed to be released on bail on depositing security of Rs. Rs.25,000/-(Twenty-Five Thousand) on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
