JUSTICE MICHAEL ZOTHANKHUMA O R D E R 12.02.2026 Heard Ms. Alito Swu, learned counsel for the petitioner who submits that the petitioner successfully executed the internal electrification of the New SP Office at Mokokchung under the work name of “Construction of District Command and Control Centre at DEF Mokokchung under MOD 2015-16, 2nd floor and Headroom (Internal Electrification)” for an amount of Rs. 15,32,900/- (Rupees Fifteen Lakhs Thirty Two Thousand and Nine Hundred). The work was successfully executed and Completion Certificate was issued by the concerned authority on 03.02.2022. Thereafter, the respondent authorities released Rs. 7,00,000/- (Rupees Seven Lakhs) to the petitioner as part payment in the year 2022. 2. As the respondents failed to release the balance bill amount, the petitioner submitted a Representation dated 24.09.2024. The SP, Mokokchung, vide Letter dated 24.09.2024 addressed to the Director General of Police, Nagaland, stated that out of the total amount of Rs. 15,32,900/- (Rupees Fifteen Lakhs Thirty Two Thousand and Nine Hundred) a sum of Rs. 7,00,000/- (Rupees Seven Lakhs) had been paid to the petitioner and the balance amount of Rs. 8,00,000/- (Rupees Eight Lakhs) was still to be paid to the petitioner. The SP accordingly requested the DGP for administrative approval and sanction, for release of Rs. 8,00,000/- (Rupees Eight Lakhs). As the respondent authorities did not pay the balance amount, the petitioner served a Legal Notice dated 11.12.2025 for release of the admitted pending bill amount of Page No.# 3/3 Rs. 8,00,000/- (Rupees Eight Lakhs). However, the same has not been released to the petitioner as on date. 3. The learned counsel for the petitioner submits that the writ petition can be disposed of, if a direction is issued to the respondent authorities to verify the bills of the petitioner and to pay to the petitioner the admitted balance amount still payable to the petitioner. The learned counsel for the petitioner also prays for impleadment of the Finance Commissioner to the Government of Nagaland, Finance Department as respondent No. 5. 4. On considering the prayer of the learned counsel for the petitioner, the Finance Commissioner to the Government of Nagaland, Finance Department, is impleaded as respondent No. 5. The petitioner shall submit a corrected copy of the Cause Title to the Registry of this Court and to the counsel for the respondents. 5. Mr. K. Angami, learned Senior Government Advocate for the respondents submits that he has got no objection to the proposal made by the learned counsel for the petitioners. 6. In view of the consent of the parties, the respondent Nos. 2 and 3 are directed to verify the bills of the petitioner and all the respondents are to pay to the petitioner the admitted amount.
