Case No. 50 of 2024 for the offences registered under Sections 341, 323, 307, 325, 326, 506, 302/34 of the Indian Penal Code pending in the Court of learned Chief Judicial Magistrate, Dhanbad, is pressed into motion. As per the FIR, on land dispute between two neighbors, this petitioner along with other eight accused persons conjointly assaulted the informant party resulting in the death of one and grievous injury to two of them. It is submitted by the learned senior counsel on behalf of petitioner that the allegation of assault by axe against the deceased is not against this petitioner. It is also submitted that the allegation against this petitioner is that he along with one Ashraf Ansari assaulted Heshamuddin and Ghulam Khawaja. Md. Ashraf Ansari has already been granted bail by the co-ordinate Bench of this Court in B.A. No.9021 of 2024. There is no allegation of causing homicidal death against this petitioner. Learned A.P.P. assisted by the learned counsel on behalf of informant opposed the bail petition. It is submitted that the deceased and two others were conjointly assaulted by the accused persons and specific overt act has been attributed to this petitioner, who was wielding rod at the time of assault. The allegation causing grievous injury has been fully substantiated during investigation. Ghulam Khawaja sustained 13 injuries including injury on brain and fracture of hand. Under the circumstances, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner stands rejected. (Gautam Kumar Choudhary, J.)
