Case No.885 of 2025 dated 04.11.2025 under Sections 64(2)(m)/89/351(2) of the BNS, 2023 & Section 6 of the Protection of Children from Sexual Offences Act, 2012. And In the matter of: Toufik Mondal ….Petitioner. Mr. Sumanta Das ….for the petitioner Mr. Partha Pratim Das Ms. Ayana De ….for the State Mr. Siddhartha Goshwami Ms. Pramita Banerjee Ms. Upasana Shaw ….for the de facto complainant Heard the learned counsels for the petitioner, the de facto complainant and the State. Perused the case diary. The prosecution case is that a few years ago the petitioner forced himself upon the victim, when she was minor, did videography and continued such act for some time. In 2025, when the victim had become major, she tried to commit suicide by consuming poison. There are medical records for her treatment for poisoning. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
