JUSTICE ANJAN MONI KALITA ORDER Date : 06.08.2026 Heard Mr. Pakinrichapbo, learned counsel appearing for the petitioner. Also heard Mr. A. Sangtam, learned Government appearing for the State respondents. The instant writ petition is filed by the petitioner challenging his termination from the post of Lecturer in Mechanical Engineering at Khelhoshe Polytechnic Atoizu without issuance of any show cause notice and or holding any departmental inquiry in gross violation of the principles of natural justice. The petitioner's case is that he was initially appointed as Lecturer in Mechanical Engineering in Khelhoshe Polytechnic Atoizu under the Department of Higher and Technical Education, Government of Nagaland on contractual basis w.e.f. 01.04.2014 against the vacancy caused due to resignation of Shri Solesul Rote, Lecturer, Mechanical Engineering, Khelhoshe Polytechnic, Atoizu w.e.f. 01.11.2013. Accordingly, he joined duties on 01.04.2014 and was continuously discharging his duties with utmost sincerity and dedication. The petitioner's contractual engagement was extended from time to time every year and the last extension was granted by order dated 17.03.2023. Accordingly, he served in the department till 17.03.2024. Since then, however, without giving any intimation or any termination order, the engagement of the petitioner was not extended by the respondent authorities. In view of the aforesaid, the petitioner has submitted a representation to the Director, Department of Higher and Technical Education, Nagaland on 19.05.2026. It is the case of the petitioner that his representation has not been considered by the respondent authorities and he has not received any information or Page No.# 3/3 response to the aforesaid representation. The learned counsel appearing for the petitioner submits that he is only praying for a limited relief that since he has already submitted his representation, and his service was terminated without any termination notice or any other communication, his grievance should be considered by the respondent authorities. The learned counsel appearing for the Government doesn't have any objection to the limited prayer made by the learned counsel appearing for the petitioner. Taking into the aforesaid facts and without going to the merit of the petition, this court is of the considered opinion that this present writ petition can be disposed of with a direction to the respondent authorities, namely, the Director, Department of Higher and Technical Education, Nagaland, Kohima to consider the representation dated 19.05.2026 submitted by the petitioner and dispose of the same within a period of one (1) month from today by way of a speaking order. A copy of which shall, thereafter, be provided to the petitioner by the Director, Department of Higher and Technical Education, Nagaland, Kohima. In terms of the aforesaid directions, the instant writ petition is disposed of. Sd/- JUDGE Comparing Assistant
