The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to set-aside the impugned transfer order dated 30.06.2025 (Annexure P/1) in respect of petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to direct the Respondent No. 1 to take decision over the representation of petitioner dated 09.07.2025 (Annexure P/5), wherein, the petitioner has requested for cancellation of her transfer order dated 30.06.2025. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to give her service at present place of posting i.e. Collector Office Dhamtari (C.G.) as Assistant Grade - III. 2 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deem fit and appropriate.” 2. Learned counsel for the petitioner submits that the petitioner though submitted an application dated 12.06.2025 for her transfer to District – Sukma, however, subsequently she realized that it will affect her services/ carrier and therefore, after issuance of the impugned transfer order dated 30.06.2025 (Annexure P/1), she submitted an application before the Committee constituted under the Transfer Policy, 2025 to cancel the order of transfer on 09.07.2025 which till date is pending consideration. He also submits that the petitioner is working in the Office of Collector, District – Dhamtari and the Collector, District – Dhamtari has also written letter to the Respondent No. 1, requesting to cancel the order of transfer of the petitioner on the ground that there is shortage of staff in the office. It is also pending consideration and therefore, direction be issued to the respondent authorities to consider and take decision on the representation at the earliest. 3. On the other hand, learned counsel for the Respondents/State would submit that though under the Transfer Policy, 2025, Committee is constituted to consider the grievance of an employee against this transfer, however, in the facts of the case, it appears that there is no error on the part of the respondent authorities to transfer the petitioner, when it is on the basis of her own application. Appropriate authority to consider the nature of grievance raised by the petitioner would be the Respondent No. 1, however, petitioner has not submitted any application/representation. 4. At this stage, learned counsel for the petitioner submits that the petitioner may be permitted to submit fresh representation before the Respondent No. 1 also and the Respondent No. 1 as also, the Committee be directed to consider the representation at the earliest, as the petitioner is still 3 working on the present place of posting. He also submits that till decision is taken on her representation, some interim protection with respect to the place of posting may be granted. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit representation before the Respondent No. 1 raising all the grounds as raised in this writ petition within a period of 10 days and if such a representation is submitted by the petitioner, the Respondent No. 1 shall consider and take decision on the representation to be submitted by the petitioner on its own merits in accordance with law, expeditiously, preferably within a period of 03 weeks from the date of receipt of representation. 7. Considering the fact that since June, 2025, petitioner is still working in the present place of posting and is not been relieved till date, it is directed that status quo as it exists today, with respect to place of posting of the petitioner shall be maintained by the parties till decision is taken on the representation. 8.
