Heard both the sides. This bail application has been filed on behalf of petitioner who is in custody since 12.09.2025 in connection with Katkamsandi (P) P.S. Case No. 134 of 2025 for the offence registered under Sections 115(2), 118(2), 126(2), 109, 125, 303(2), 351(2), 352, 76, 85 and 3(5) of the BNS, 2023 and under Section of ¾ Dowry Prohibition Act 1961 and ¾ Muslim Woman (Protection of right on marriage) Act, 2019 pending in the Court of learned J.M. 1st Class, Hazaribag, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that offence under Section 109 of the BNS will not be made out in the present case. Petitioner is the husband and the marriage was solemnized 13 years ago as per FIR. The allegation of assault is not substantiated by the injury report and marital discord has resulted in the present case. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
