HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 39994 of 2026 Court No. - 2 HON'BLE J.J. MUNIR, J.
HON'BLE INDRAJEET SHUKLA, J. The petitioner seeks a mandamus commanding respondent nos.4 to 6, who are private men not to dispossess the petitioner from his bhumidhari land. The cause of action disclosed is absolutely under the private law with no public element to it. Report to the police would not change its complexion. The remedy of the petitioner is by way of suit before the Civil Court of ordinary original jurisdiction and he has already instituted Original Suit No.82 of 2026 before the Civil Judge (Junior Division), Puwayan, Shahjahanpur for the relief of permanent prohibitory injunction. An application for temporary injunction has also been made in the said suit. The contention of the learned Counsel for the petitioner is that no ad- interim injunction has been granted and the proceedings of the Suit are lingering on. In the circumstances, we direct the Civil Judge (Junior Division), Puwayan, Shahjahanpur to pass appropriate orders on the application for temporary injunction by fixing two dates of effective hearing within three weeks. This petition is disposed of in terms of aforesaid order. October 1, 2026 S.P.
