Heard the parties. 2. In this writ petition, the petitioner has prayed for following reliefs:- “a) For issuance of an appropriate writ, order or direction in the nature of mandamus, commanding the respondent authorities concerned to grant 2nd & 3rd ACP/MACP to the petitioner with financial benefits as his total service period is more than 41 years. b) For issuance of an appropriate writ, order or direction in the nature of mandamus, commanding the concerned respondent to make payment of any amount which will accrue by way of grant of the benefits of 2nd and 3rd 2026:JHHC:2921 2 ACP/MACP to the petitioner along with interest at a statutory rate. c). For issuance of writ, in the nature of mandamus, commanding the respondent authorities concerned for revision of pension along with post-retiral benefits on account of grant of 2nd & 3rd ACP/MACP. d). For issuance of writ of the nature of mandamus directing the concerned respondent to commute monthly pension payable to petitioner taking into consideration benefit of 2nd & 3rd ACP/MACP and initiate payment of monthly pension to petitioner with effect from February, 2020. e). For issuance of any other appropriate writ(s), order(s) direction(s) as this Hon’ble Court may deem fit and proper for grant of any other considerable relief(s) to the petitioner under the facts and circumstances of this case.” 3. Learned counsel appearing on behalf of the respondents submits that if the petitioner files a fresh representation, before the Deputy Commissioner, Sahebganj - respondent No.3, his case will be considered and an appropriate order will be passed as per law. 4. Considering the submission of the parties, I direct the petitioner to file a fresh representation within four weeks before the Deputy Commissioner, Sahebganj -respondent No.3. On receipt of the said representation, the case of the petitioner will be considered within six weeks and if it is necessary to place the case before any committee or any authority, the same should be placed during the said period. 5. If it is found that the petitioner is entitled for any amount, the same will be granted within four weeks thereafter. 6. If any part of the claim of the petitioner is rejected, the reasons thereof should be communicated to the petitioner within the aforesaid period. 7.
