JUSTICE JAYANT BANERJI) 1. The parties are present in person in the Court along with their respective advocates. 2. An application under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 has been presented today in the Court, which is a settlement agreement entered into between the parties. 3. The appellant states that she is working as a teacher in a private school. The husband is working as a Conductor with the Bengaluru Metropolitan Transport Corporation. The parties have a minor daughter. A sum of Rs.5,00,000/- by means of a - 3 - HC-KAR NC: 2026:KHC:7568-DB MFA No. 9494 of 2018 demand draft has been handed over in the Court to the appellant, subject to the terms and conditions mentioned in the aforesaid settlement. Additionally, a sum of Rs.3,50,000/- has been paid by another demand draft to the appellant today in Court. 4. The agreement of the parties is that the custody of the minor daughter will be with her mother, that is the appellant, with visiting right reserved to the respondent between 11.00 a.m. to 03.00 p.m. on every Sunday. The said payment of Rs.8,50,000/- is towards full and final settlement of the claims of the appellant and it has been stated that she will not have any claim against the respondent in future. On a query being put, the parties state that they have entered into this settlement voluntarily, of their own free will and accord and without any undue influence or coercion. 4. In view of the aforesaid, the appeal stands disposed of in terms of the aforesaid settlement. The settlement shall form part of the decree. - 4 - HC-KAR NC: 2026:KHC:7568-DB MFA No. 9494 of 2018 5. The decree made by the IV Additional Principal Judge, Family Court, Bengaluru on 01.09.2018 in Matrimonial Case No.1525/2011 is confirmed.
