APHC010481772026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3521] FRIDAY, THE 25th DAY OF SEPTEMBER 2026 PRESENT THE HONOURABLE DR JUSTICE Y. LAKSHMANA RAO CRIMINAL PETITION NO: 8118/2026 Between: PANGI CHITTIBABU, S/O. MUSURU,AGED ABOUT 50 YEARS,OCC AGRICUITURIST,R/O. KOTAGUNNALU VILLAGE,KUDUMASARI PANCHAYAT,CHINTAPALLI MANDAL,ALLURI SEETHARAMA RAJU ...PETITIONER/ACCUSED AND THE STATE OF ANDHRA PRADESH, Rep. by its Public Prosecutor,High Court of Andhra Pradesh,Amaravati ...RESPONDENT/COMPLAINANT Counsel for the Petitioner/accused: KAKUMANU JOJI AMRUTHA RAJU Counsel for the Respondent/complainant: PUBLIC PROSECUTOR 2 Dr.YLR,J Crl.P.No.8118 of 2026 Dated 25.09.2026 The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.04 of 2026 of Annavaram Police Station, ASR District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Mr.Kakumanu Joji Amrutha Raju, the learned counsel for the petitioner, submits that the petitioner is innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the petitioner is the sole earning member of the family and, therefore, his continued incarceration would cause undue hardship to his dependents. The petitioner undertakes to strictly adhere to any conditions that may be imposed by this Court. Hence, it is urged that the petition be allowed. 3. Per contra, Mr.A.Sai Rohith, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner and submitted that, though the charge sheet has already been filed, the accusations against the petitioner are well founded. Hence, he prayed that the Criminal Petition be dismissed. 3 Dr.YLR,J Crl.P.No.8118 of 2026 Dated 25.09.2026 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, this is the second bail application filed by the petitioner/Accused No.1. This Court, in Crl.P.No.6534 of 2026, vide order dated 07.08.2026, dismissed the first bail application filed by the petitioner/Accused No.1, as the charge-sheet had already been filed. The allegation against the petitioner is that he was involved in dealing with 308.00 kgs of ganja, which is not only a commercial quantity but also a colossal quantity. The petitioner is a permanent resident of ASR District and has got fixed abode. 6. Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the petitioner/Accused No.1, and in view of the fact that there is no change in the circumstances from the date of dismissal of the first bail application till the filing of the present (second) bail application, this Court is not inclined to enlarge the petitioner/Accused No.1 on bail at this juncture. Hence, this Court finds no merit in the Criminal Petition. Accordingly, the Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
