This is a petition under Section 9 of the Arbitration and Conciliation Act, 1996, seeking the following prayer: “(a) Direct the Respondent to forthwith hand over vacant, peaceful and physical possession of the Demised Premises, i.e. Flat No. CGD-026, DLF Capital Greens, Phase-1, Shivaji Marg, Moti Nagar, New Delhi –110015, along with parking space No. PD2032, to the Petitioner, pending the arbitral proceedings; (b) Restrain the Respondent, his agents, representatives and any person claiming through or under him, by an order of interim injunction, from sub-letting, assigning, parting with possession of, inducting any third party into, or in any manner creating any third-party right, title or interest in the Demised Premises or any part thereof, pending the arbitral proceedings; (c) Restrain the Respondent, his agents and representatives, by an order of interim injunction, from raising any construction, carrying out any structural additions or alterations, or damaging, removing or dealing with the fittings and fixtures in the Demised Premises, pending the arbitral proceedings; (d) Direct the Respondent to pay to the Petitioner, and/or to deposit before this Hon’ble Court, damages / mesne profits / use and occupation charges in respect of the Demised Premises at the agreed rate of Rs.70,00/- per month together with the additional agreed sum of Rs.1,000/- per day in terms of Clause 20 of the Lease Agreement, with effect from 01.07.2026 till the date of handover of vacant possession, and/or to furnish adequate security therefor, This is a digitally signed order. Mr. Rahat Sharma, respondent, appears in person, and submits that he is ready and willing to vacate the said premises on or before 31.07.2026. 3. Mr. Rahat Sharma is directed to place on record an affidavit of undertaking in support of the statement tendered today in a week. He further undertakes to pay all the dues/rentals pending on or before 31.07.2026. 4. Binding Mr. Sharma to the aforesaid statement and subject to his filing the affidavit in terms of the aforesaid directions, the petition is disposed of accordingly.
