Heard learned counsel Shri Uday Gosavi for petitioners and learned Additional Government Pleader Shri S.S.Doifode for respondents/State. Rule. Returnable forthwith. Heard finally by consent. 2. By this petition, petitioner No.1 has challenged detention and seizure of passenger vehicle owned by him bearing registration No.MH-40/N/7989 (the said vehicle) by respondent No.2 and seeks declaration that action of respondent No.2 is illegal, arbitrary, and contrary to provisions of the Motor Vehicles Act, 1988. Petitioner No.1 further seeks release of the said vehicle. 3. Petitioner No.1 is owner of the said vehicle having Special Valid Permit in the State of Maharashtra for route Nagpur- Kagajnagar. The said Permit is issued by the State Regional .....2/- Judgment wp672.26.odt 3 Transport Authority, Nagpur Rural and it is valid for the period from 21.8.2026 to 31.8.2026. 4. On 12.8.2025, the Deputy Commissioner of Police, Nagpur released a Press-Note thereby informing the public at large that restrictions are imposed on Private Luxury Buses owned by Private Bus Operators from parking on road and Pickup & Drop on road between 8:00 am to 10:00 pm. It further notifies that Private Bus Operators or Owners having their own parking are only permitted for Pickup & Drop passengers and Transporters who are not having such facilities are prohibited to do so. The said Notification was in operation from 13.8.2025 to 12.9.2025. 5. The Deputy Commissioner of Police, Nagpur on 12.9.2025 issued a Notification and continued restrictions imposed while releasing Press-Note on 12.8.2025 from the period from 13.9.2025 to 12.3.2026. The said Notification denotes Sections 115, 116, and 117 of the Motor Vehicles Act. Petitioner No.1 along with private Private Bus Owners has challenged the Notification issued by the .....3/- Judgment wp672.26.odt 4 Deputy Commissioner of Police, Nagpur by way of Writ Petition No.4738/2025 before this Court and the same is pending. 6. The Deputy Commissioner of Police, Nagpur on 12.3.2026, issued another Notification and continued restrictions imposed vide Press-Note released on 12.8.2025 which was continued vide Notification dated 12.9.2025 for a further period from 13.3.2026 to 12.3.2027. On 21.8.2026, respondent No.2 lodged FIR bearing Crime No.338/2026 under Sections 223 and 285 of the BNS against petitioner No.2 who is driver alleging violation of Notification dated 12.3.2026. Respondent No.2 also seized the said vehicle when the said vehicle left the parking and took a quick stop at the office of petitioner No.1 for pickup of passengers before leaving for its journey. The property search and seizure form demonstrates that the said vehicle was standing at the office of petitioner No.1 and was not parked on the road. Respondent No.1 on 21.8.2026 issued a Notice to petitioner No.2 thereby informing petitioner No.2 to remain present before respondent No.2. Petitioner No.2 was also handed .....4/- Judgment wp672.26.odt 5 over with a copy of Notice. Petitioner No.2 also remained present before the Court of JMFC on 24.8.2026. 7. As per contentions of petitioners, Section 207 of the Motor Vehicles Act empowers any police officer or other person authorized in this behalf by the State Government may, if he has reason to believe that a motor vehicle has been or is being used in contravention of the provisions of section 3 or section 4 or section 39 or without Permit required by sub-section (1) of Section 66 or in contravention of any condition of such Permit relating to the route on which or the area in which or the purpose for which the vehicle may be used. 8. Similarly, Section 115 of the Motor Vehicles Act states that the State Government on being satisfied is empowered to issue a Notification prohibiting or restricting driver of motor vehicle or any specified class or description of any motor vehicle either generally in a specified area or on a specified road may impose such restrictions or any prohibition by erecting or placing traffic signals as mentioned in Section 116. .....5/- Judgment wp672.26.odt 6 9. Thus, it is the contentions of petitioners that neither Section 207 nor Section 115 of the Motor Vehicles Act is applicable. Similarly, the offence is not made out either under Section 223 or Section 285 of the BNS and, therefore, the entire action of respondent No.2 is illegal and arbitrary and it is liable to be quashed and set aside. 10. Learned counsel for petitioners reiterated the said contentions and submitted that considering the said vehicle was parked in front of the office in the parking area, no such action of respondent No.2 was required. Without satisfying respondent No.2, the said vehicle is seized. He submitted that Section 207 does not empower any officer to take such an action and, therefore, the writ petition deserves to be allowed. 11. In support of his contentions, learned counsel for petitioners placed reliance on the decision in the case of State of Maharashtra and ors vs. Nanded-Parbhani ZLBMV Operator Sangh, reported in (2000)2 SCC 69. .....6/- Judgment wp672.26.odt 7 12. Per contra, learned Additional Government Pleader for respondents/State submitted that as the Notification in question is already under challenge in a civil writ petition, the present petition is not maintainable. He submitted that in view of registration of the offence, an action was taken by respondent No.2 and, therefore, the writ petition being devoid of merits is liable to be dismissed. 13. On hearing both sides and perusing the entire record, it reveals that the action against petitioners was taken in view of the Notification issued by respondent No.2. ( लोविहत मतानी, भापोस उप आयुक्ते कार्यालय सिव्हील लाईन्स) पोलीस उप आयुक्त उपायुक्त, वाहतूक, नागपू शह" 15. The said Notification was issued by the Deputy Commissioner of Police, Traffic, Nagpur City. As per the said Notification, Transporters or Private Buses’ Drivers and Owners were prohibited from parking their Private Buses on the Ring Road vicinity either for parking or for Pickup & Drop. The other conditions show that the said Notification was not applicable to Buses run by the Maharashtra State Road Transport Corporation, Buses run by various companies for transportation of employees, vehicles or Buses used on a direct basis for wedding and other events, Ambulance, Emergency Services, and School Buses. It is specifically mentioned in the said Notification that on contravention of the said Notification, concerned person would be liable for action under Section 223 of the BNS. .....13/- Judgment wp672.26.odt 14 16. The first objection raised by learned counsel for petitioners is that, the Deputy Commissioner of Police is not empowered to exercise his/her powers to issue such type of Notifications. He invited our attention towards Section 10 of the Maharashtra Police Act, which reads as under: “10. Deputies to Commissioner. (1) The State Government may appoint one or more Deputy Commissioners of Police in Greater Bombay or in any area in which a Commissioner has been appointed under clause (a) of section 7. (2) Every such Deputy Commissioner shall, under the orders of the Commissioner, exercise and perform any of the powers, functions and duties of the Commissioner to be exercised or performed by him under the provisions of this Act or any other law for the time being in force in accordance with the general or special orders of the State Government made in this behalf: Proviso to the said Section shows that powers to be exercised by the Commissioner of making, altering or rescinding rules under section 33 shall not be exercisable by a Deputy Commissioner. .....14/- Judgment wp672.26.odt 15 17. Section 33 of the Maharashtra Police Act deals with power to make rules for regulation of traffic and for preservation of order in public place, etc.. In view of Section 33(1)(c), the Commissioner with respect to any of the matters specified in this sub-section for regulating the conditions under which vehicles may remain standing in streets and public places, and the use of streets as halting places for vehicles or cattle. 18. Thus, Section 33 of the Maharashtra Police Act empowers only the Commissioner to regulate under conditions under which vehicles may remain standing in streets and public places. 19. Thus, contention of learned counsel for petitioners is that, in view of both provisions under Sections 10 and 33 of the Maharashtra Police Act, the Deputy Commissioner is not at all empowered to issue such type of Notification. On that ground itself, the Notification is bad in law. 20. The power of seizure under Section 207(1) of the Motor Vehicles Act has been conferred upon the appropriate authority .....15/- Judgment wp672.26.odt 16 which power is in fact a sovereign power of the State and has been delegated to the police officer in discharge of their duties of law enforcement and in the enforcement of an orderly society. 21. Section 207 of the Motor Vehicles Act deals with power to detain vehicles used without certificate of Registration Permit. The said Section is reproduced below for reference: “207. Power to detain vehicles used without certificate of registration permit, etc. - (1) Any police officer or other person authorized in this behalf by the State Government may, if he has reason to believe that a motor vehicle has been or is being used in contravention of the provisions of section 3 or section 4 or section 39 or without the permit required by sub-section (1) of section 66 or in contravention of any condition of such permit relating to the route on which or the area in which or the purpose for which the vehicle may be used, seize and detain the vehicle, in the prescribed manner and for this purpose take or cause to be taken any steps he may consider proper for the temporary safe custody of the vehicle: Provided that where any such officer or person has reason to believe that a motor vehicle has been or is being used .....16/- Judgment wp672.26.odt 17 in contravention of section 3 or section 4 or without the permit required by sub-section (1) of section 66 he may, instead of seizing the vehicle, seize the certificate of registration of the vehicle and shall issue an acknowledgment in respect thereof. (2) Where a motor vehicle has been seized and detained under sub-section (1), the owner or person in charge of the motor vehicle may apply to the transport authority or any officer authorized in this behalf by the State Government together with the relevant documents for the release of the vehicle and such authority or officer may, after verification of such documents, by order, release the vehicle subject to such conditions as the authority or officer may deem fit to impose.” 22. In view of Section 207 of the Motor Vehicles Act, the power, therefore, is required to be exercised with a care and caution and only when precondition for exercise a power is fully satisfied. The police officer would be authorized to detain a vehicle, if he has reason to believe that a motor vehicle has been or is being used in contravention of provisions of Section 3 or .....17/- Judgment wp672.26.odt 18 Section 4 or Section 39 or without the permit required by sub- section (1) of Section 66 or in contravention of any condition of such permit relating to the route on which or the area in which or the purpose for which the vehicle may be used. 23. Section 3 of the Motor Vehicles Act, deals with necessity for driving licence, which states that no person shall drive a motor vehicle in any public place unless he holds an effective driving licence issued to him authorizing him to drive the vehicle; and no person shall so drive a transport vehicle [other than a motorcab or motor cycle] hired for his own use or rented under any scheme made under sub-section (2) of section 75 unless his driving licence specifically entitles him so to do. 24. Similarly, Section 39 of the Motor Vehicles Act deals with necessity for registration, which states that no person shall drive any motor vehicle and no owner of a motor vehicle shall cause or permit the vehicle to be driven in any public place or in any other place unless the vehicle is registered in accordance with this .....18/- Judgment wp672.26.odt 19 Chapter and the certificate of registration of the vehicle has not been suspended or cancelled and the vehicle carries a registration mark displayed in the prescribed manner. 25. Section 66 of the Motor Vehicles Act deals with necessity for permits, which states that no owner of a motor vehicle shall use or permit the use of the vehicle as a transport vehicle in any public place whether or not such vehicle is actually carrying any passengers or goods save in accordance with the conditions of a permit granted or countersigned by a Regional or State Transport Authority or any prescribed authority authorizing him the use of the vehicle in that place in the manner in which the vehicle is being used. 26. In the light of above these provisions, Section 207 of the Motor Vehicles Act is very clear which states that a police officer would be authorized to detain a vehicle, if he has reason to believe that a motor vehicle has been or is being used in contravention of the provisions of Section 3, i.e. if there was no .....19/- Judgment wp672.26.odt 20 driving licence, or Section 39 if the vehicle was driven without its registration, and or Section 66 if vehicle is run over the road without Permit. 27. As far as present case is concerned, the FIR discloses allegations that the said vehicle was found parked on the road. Thus, the FIR nowhere alleges that the said vehicle was driven by the driver who is not having valid driving licence or permit. There is no dispute regarding fact that petitioner No.1 was holding Permit on respective dates i.e. 21.8.2026 to ply the said vehicle on Nagpur-Kagaznagar. 28. Thus, allegations are only that petitioners have contravened the Notification and, therefore, a question remains whether respondent No.2 is having right to seize the said vehicle. Respondent No.2 can seize the said vehicle either under Section 102 of the CrPC or under Section 207 of the Motor Vehicles Act. .....20/- Judgment wp672.26.odt 21 29. Section 102 of the CrPC (106 of the BNSS) deals with power of police officer to seize certain property, which reads as under: “106. Power of police officer to seize certain property. (1) Any police officer may seize any property which may be alleged or suspected to have been stolen, or which may be found under circumstances which create suspicion of the commission of any offence. (2) Such police officer, if subordinate to the officer in charge of a police station, shall forthwith report the seizure to that officer. (3) Every police officer acting under sub-section (1) shall forthwith report the seizure to the Magistrate having jurisdiction and where the property seized is such that it cannot be conveniently transported to the Court, or where there is difficulty in securing proper accommodation for the custody of such property, or where the continued retention of the property in police custody may not be considered necessary for the purpose of investigation, he may give custody thereof to any person on his executing a .....21/- Judgment wp672.26.odt 22 bond undertaking to produce the property before the Court as and when required and to give effect to the further orders of the Court as to the disposal of the same. 30. The above said Section authorizes a police officer to seize property, but it is not as per whims of police officer. The property which may be alleged or suspected to have been stolen or which may be found under circumstances which create suspicion of the commission of any offence. 31. In the instant case, there were no allegations that either the said vehicle is stolen or was found in such a circumstance which create a suspicion and, therefore, respondents have no right even to seize the said vehicle by using Section 106 of the BNSS. 32. We have already observed that application of Section 207 of the Motor Vehicles Act, on scrutiny of the above provisions, shows that power to seize and detain motor vehicle is traceable in the said Section. The police officer or any other person authorized, .....22/- Judgment wp672.26.odt 23 if he has reason to believe that a motor vehicle has been or is being used in contravention of the provisions of section 3 or section 4 or section 39 or without the permit required by sub-section (1) of section 66 or in contravention of any condition of such permit relating to the route on which or the area in which or the purpose for which the vehicle may be used. The seizure requires to be based on prima facie assessment of violation of the Act. On seizure of the vehicle, proceeding would be lodged against driver and owner of vehicle under relevant provisions of the Motor Vehicles Act. 33. It well settled that power of seizure shall not be taken to be a punitive measure though there is certain element of deterrence in it. Such discretion is expected to be exercised judiciously. The seizure cannot be an end in itself, but it should be a means to achieve implementation of the order. The vehicle seized under Section 207 of the Motor Vehicles Act on the ground of contravention of Notification should not be detained for unduly long time and if any representation filed by the vehicle owner ought to be considered with expedition by imposing certain conditions. .....23/- Judgment wp672.26.odt 24 34. The Hon’ble Apex Court, in the case of State of Maharashtra and ors vs. Nanded-Parbhani ZLBMV Operator Sangh (supra), has specifically observed as under: “The aforesaid power of seizure has been conferred upon the appropriate authority, which power is in fact a sovereign power of the State and has been delegated to the police officer in discharge of their duties of law enforcement and in the enforcement of an orderly society. The power, therefore, is required to be exercised with care and caution and the power has to be exercised only when the pre-condition for exercise of power is fully satisfied. It is a cardinal principle of rule of construction of statute that when the language of a statute is fairly and reasonably clear, then inconvenience or hardships are no considerations for refusing to give effect to that meaning. It is not the contention of the learned counsel, appearing for the State nor can it be said that on giving a plain meaning to the words used in Section 207(1) of the Act, there will be any absurdity or would make the statute offending any provisions of the Constitution. It has further been held as under: .....24/- Judgment wp672.26.odt 25 “If the words of the statute are in themselves precise and unambiguous, then no more can be necessary than to expound those words in their natural and ordinary sense. The words themselves do alone in such cases best declare the intent of the lawgiver.” It has further been specifically observed in paragraph No.11, as under: “The intention of the legislature is required to be gathered from the language used and, therefore, a construction, which requires for its support with additional substitution of words or which results in rejection of words as meaningless has to be avoided. Bearing in mind, the aforesaid principles of construction of statute and on examining the provisions of Section 207 of the Act, which has been quoted earlier, we have no doubt in our mind that the police officer would be authorized to detain a vehicle, if he has reason to believe that the vehicle has been or is being used in contravention of Section 3 or Section 4 or Section 39 or without the permit required under sub-section (1) of Section 66 or in contravention of any condition of such permit relating to the route on .....25/- Judgment wp672.26.odt 26 which or the area in which or the purpose for which the vehicle may be used. In the case in hand, we are not concerned with the contravention of Section 3 or Section 4 or Section 39 or sub-section (1) of Section 66 and we are only concerned with the question of contravention of the condition of permit. Reading the provisions as it is, the conclusion is irresistible that the condition of permit relating to the route on which or the area in which or the purpose for which the vehicle could be used if contravened, would only authorize the police officer to detain the vehicle and not each and every condition of permit on being violated or contravened, the police officer would be entitled to detain the vehicle. According to the learned counsel, appearing for the State of Maharashtra, the expression "purpose for which the vehicle may be used" could be construed to mean that when the vehicle is found to be carrying passengers more than the number prescribed in the permit, the purpose of user is otherwise.” 35. A scrutiny of the above provisions shows that power to seize and detain a motor vehicle is traceable under Section 207 of the Motor Vehicles Act. The police officer or any other person .....26/- Judgment wp672.26.odt 27 authorized is empowered to seize vehicle, if he has reason to believe that a motor vehicle has been or is being used in contravention of the provisions of section 3 or section 4 or section 39 or under Section 66 of the Motor Vehicles Act. The seizure requires to be based on prima facie assessment of violation of the Act. On seizure of the vehicle, proceeding would be lodged against driver and owner of vehicle under relevant provisions of the Motor Vehicles Act. The necessity and objective behind seizure; the time within which the competent authority shall consider and decide the application filed under Section 207 and Rules for release of vehicle are clear. The procedure requires to be followed for detention and seizure of vehicles are prescribed under the statutory provisions of the Motor Vehicles Act and the CrPC. Section 102 of the CrPC empowers the police officer to seize any property which may be alleged or suspected to have been stolen, or which may be found under circumstances creating suspicion of the commission of any offence. Section 207 of the Motor Vehicles Act empowers any police officer authorized on behalf of the State Government to seize or .....27/- Judgment wp672.26.odt 28 detain a vehicle if it is found in contravention of the provisions of section 3 or section 4 or section 39 or Section 66 of the Act. Similarly, procedure described under Section 457 of the CrPC is also relevant. 36. Admittedly, seizure of the property made by the police officer ought to be reported to the Magistrate who has discretion to pass an order disposing of the property to person entitled to its possession. 37. Thus, no doubt, Section 207 of the Motor Vehicles Act are special provisions but even so, a police officer or the person authorized by the State Government under the said enactment shall cease to exercise powers under section 207 of the Motor Vehicles Act qua the vehicle which is subject matter of criminal case of which cognizance is taken by the Court, consequent to the registration of offence and making the said vehicle as a crime property. 38. Admittedly, issue as to the Notification is pending before this court in other civil writ petition. .....28/- Judgment wp672.26.odt 29 39. As far as the Notification in the present case is concerned, admittedly, Section 10 of the Maharashtra Police Act only empowers the Commissioner to issue Notification in view of proviso to the said Section. 40. The respondents lodged the FIR alleging contravention of Sections 223 and 285 of the BNS. Section 223 is applicable when there is disobedience to order duly promulgated by a public servant. 41. The seizure panchanama and recital of the FIR itself shows that the said vehicle was seized when it was standing in front of the office of “Dhanshree Travels”. Therefore, apparently, there is no violation of the Notification which is promulgated as the said Notification specifically states that there should not be parking for Pickup & Drop on the road and this Notification would not apply when the said vehicle was parked at the parking place of the travels company and, therefore, Section 223 is not applicable in the present case. .....29/- Judgment wp672.26.odt 30 42. Similarly, Section 285 of the BNS is also not attracted as there is no allegation that the said vehicle was parked in such a condition causing danger or obstruction in a public way or line of navigation. Therefore, the detention of the said vehicle is unauthorized 43. In this view of the matter, as we find that the detention and seizure of the said vehicle owned by petitioner No.1 is illegal, arbitrary, and contrary to the provisions of the Motor Vehicles Act, we proceed to pass following order: ORDER (1) The Criminal Writ Petition is allowed. (2) The detention and seizure of vehicle bearing registration No.MH-40/N/7989 owned by petitioner No.1 is hereby declared arbitrary.
