---- 04/03.02.2026 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Basisthnagar PS Case No.66 of 2025, for offence registered under section 274, 275, 317(5), 336(3), 336(4), 338, 340, 3(5) of BNS, 2023 and section 47(a) of Excise Act, pending in court of learned Chief Judicial Magistrate, Chatra.

Learned counsel for petitioner submits that allegations are made that Scorpio with foreign liquor was found and Pappu Bhuiyan was apprehended along with Scorpio vehicle. He further submits that Munna Dangi was also on the said vehicle who fled away and Pappu Bhuiyan has taken name of the petitioner. He then submits that the petitioner has nothing to do with the said liquor and the said vehicle. He next submits that the petitioner is having one criminal antecedent and in that case the petitioner has been

acquitted. He also submits that in identical situation one co-accused has already been granted anticipatory bail in A.B.A. No.7122 of
2025.
4. Learned State counsel opposes prayer and submits that name of petitioner has come on confessional statement of co- accused.

Considering that name of the petitioner has come on confessional statement of co-accused and it has been pointed out that the petitioner has nothing to do with the said liquor and in identical situation one co-accused has already been granted anticipatory bail in the aforesaid A.B.A., I am inclined to grant anticipatory bail to petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Basisthnagar PS Case No.66 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
