CORAM : URMILA JOSHI-PHALKE AND R
AJ D.
WAKODE
, JJ.
DATE : 28.09.2026 Heard learned counsel for the petitioner.
2. The petitioner has approached this Court seeking a direction to the learned Additional Chief Judicial Magistrate, Akola, to decide and finally dispose of Criminal Misc. Application No. 1312 of 2024, along with all the applications pending therein.
3.
Learned counsel for the petitioner has invited our attention to the Roznama of the aforesaid proceedings, placed on record at page No. 50 (Annexure-IV). Perusal of the aforesaid Roznama reveals that the proceedings were instituted by the respondent-wife on 16.10.2024. The aforesaid proceedings are pending before the learned Trial Court for almost two years.
4.
Learned counsel for the petitioner submits that, under Section 12 of the Protection of Women from Domestic Violence Act, 2005, the aforesaid proceedings are expected to 2026:BHC-NAG:12840-DB
103.Cri.WP.750.2026 2/2 be decided within a period of 60 days. However, despite the lapse of more than two years, the proceedings are still pending before the learned Trial Court.
5. Perusal of the Roznama further reveals that the learned Trial Court has not proceeded with the matter on merits and has, from time to time, kept the proceedings for consideration of various applications, including those at Exhibits 15, 18, 20 and 23. Learned counsel for the petitioner submits that such prolonged pendency is causing great prejudice to the petitioner.
6. In view of the above, we dispose of the present writ petition with a direction to the learned Additional Chief Judicial Magistrate, Akola, to decide the interim applications pending in the aforesaid proceedings, bearing Exhibit Nos. 5, 15, 18, 20, 28, 29, 30, 32 and 37, within a period of two months from the next date of hearing.
7. The learned Trial Court is also directed to hear and finally decide the main proceedings, i.e. Criminal Misc. Application No. 1312 of 2024, within a period of one year from the next date of hearing.
8. The writ petition is accordingly disposed of.
