Sadar, District Chatra .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opp. Party CORAM: HON'BLE MR. JUSTICE GAUTAM KUMAR CHOUDHARY For the Petitioner : Ms. Tejaswi, Advocate For the State : Mr. Sudhir Kumar Mahto, A.P.P. ------ Order No.03 / Dated : 03.02.2026 Bail petition filed on behalf of the petitioner- Md. Toufique @ Md. Toshir, who is in custody since 09.12.2024 in connection Chatra Sadar P.S. Case No. 374 of 2024 corresponding to POCSO Case No. 05 of 2025 for the offence registered under Sections 74 and 352 of Bhartiya Nyaya Sanhita, 2023 and Section 8 of POCSO Act, pending in the Court of learned Special Judge, POCSO Act, Chatra, is pressed into motion. As per the FIR, when the victim girl along with his sister used to go to attend her coaching classes, this petitioner used to make improper sexual advances against her and physically molested her. On being protested, she was abused and assaulted. It is submitted by the learned counsel on behalf of petitioner that he has no criminal antecedent of similar nature and is fairly young aged around 19 years. Learned A.P.P. opposed the bail petition. It is submitted that the petitioner is named in the FIR and there is direct and specific allegation against him of stalking and molesting the victim girls. Considering the nature of offence where it has become a menace for the girls to go to their school or tuition, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner stands rejected. (Gautam Kumar Choudhary, J.) Anit Uploaded 04.02.2026
