JUSTICE JASMEET SINGH O R D E R % 06.07.2026 1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- “ a. Issue a Writ of Mandamus directing Respondent No, 1 thereby allowing change of nomination in the policies held by the petitioner. and also to remove Respondent No. 2 as nominee of the Petitioner; b. Declare that the GPA, now cancelled or any other documents which are not in knowledge of the Petitioner relied upon by Respondent No. 2 does not restrict the Petitioner’s rights under law; c. Direct Respondent No. I to ignore any GPA or similar document, which is not in the nature of assignment under Section 38 of the Insurance Act. d. Issue appropriate directions restraining Respondent No. This is a digitally signed order. Direct Respondent No. I to decide the representation dated 26.02.2026 filed by the Petitioner within 4 weeks; f. Direct Respondent No. 3 to maintain status quo in respect of the joint bank account and not to permit unilateral withdrawals by Respondent No. 2….” 2. Mr. Mehta, learned counsel appearing for the LIC states that for granting the reliefs sought, the petitioner is required to come to the office of respondent no. 1 and complete certain formalities. 3. Taking the statement of Mr. Mehta, learned counsel for respondent no. 1 on record and binding the respondent no. 1 to the same, it is directed that the petitioner shall appear in the office of respondent no. 1 along with the sons on 17.07.2026 at 11:30 AM. 4. Subject to the petitioner completing the formality, the respondent no. 1 shall do the needful. 5. Mr. Kakar, learned counsel for respondent no. 2 opposes and states that the prayers cannot be granted as after the assignment in favour of respondent no. 2, it becomes a joint policy. 6. However, I am of the view that the petitioner is the owner of the policy and should be permitted to make changes in accordance with law and as per extant rules of respondent no. 1 7.
