The present Transfer Petition has been filed under Section 24 read with Section 151 of the Code of Civil Procedure, 1908, seeking transfer of HMA No. 98/2026 titled as “Satyajeet Panda v. Simran Roy”, presently pending before the Court of the learned Judge, Family Court-01, South-West District, Dwarka Courts, New Delhi, to the Court of the learned Principal Judge, Family Court, North-West District, Rohini Courts, Delhi. 2. Learned counsel appearing on behalf of the Petitioner submits that the present transfer has been sought on the ground that the Petitioner has no independent source of income and is financially dependent upon her father and brother for meeting her day-to-day expenses. 3. He further submits that the Petitioner is presently pursuing a teacher training course with a view to securing future employment and, therefore, finds it difficult to commute to the Family Court at Dwarka on each date of hearing. Per contra, learned counsel appearing on behalf of the Respondent submits that the additional commuting time between Rohini Courts and Dwarka Courts is only about 25–30 minutes and, therefore, the same cannot constitute a valid ground for transfer. 5. Having considered the submissions made by the parties, this Court is of the opinion that the Petitioner has disclosed sufficient cause for seeking transfer of the matrimonial proceedings. The inconvenience pleaded by the Petitioner appears to be genuine, and, in the facts of the present case, no prejudice is likely to be caused to the Respondent if the proceedings are transferred. 6. Save and except the contention regarding the additional commuting time, no other substantial objection has been raised by the Respondent opposing the present Petition. 7. Accordingly, the present Petition deserves to be allowed. 8. Resultantly, HMA No. 98/2026 titled “Satyajeet Panda v. Simran Roy” is transferred from the Court of the learned Judge, Family Court-01, South-West District, Dwarka Courts, New Delhi, to the Court of the learned Principal Judge, Family Court, North-West District, Rohini Courts, Delhi. 9. The learned Judge, Family Court-01, South-West District, Dwarka Courts, New Delhi, is requested to transmit the complete judicial record to the transferee Court within a period of ten (10) days from today. 10. Accordingly, the present Petition along with pending application(s), if any, stands disposed of in the aforesaid terms.
