JUSTICE DEVASHIS BARUAH ORDER Date : 31.07.2026 This is an application filed alleging willful and deliberate violation to the order dated 10.10.2018 passed in WP(C) No.7220/2018 whereby there was a specific direction upon the Chief Engineer, PHE to consider the representation dated 01.09.2018 filed by the Petitioner for making payment of the outstanding dues with interest within period of 3 (three) months Page No.# 3/4 from the date of receipt of certified copy of the order. 2. Mr. R. R. Gogoi, the learned Standing counsel who appears for the Respondents/Contemnors submitted that a Speaking Order has been passed on 30.07.2026 thereby disposing of the representation dated 01.09.2018. A copy of the Speaking Order has been placed before this Court which is kept on record and marked with the letter “X”. 3. Taking into account that there has been a Speaking Order passed in compliance with the order dated 10.10.2018 passed in WP(C) No.7220/2018, this Court is of the opinion that further pursuing with the present contempt application would not be in the interest of justice. 4. Accordingly, the contempt proceedings stands closed. 5. Before parting with the records, this Court observes that the closure of the instant contempt application on account of passing of the Speaking Order shall not prejudice the Petitioners if so aggrieved to initiate such proceedings as permissible under law. 6. This Court further observes that taking into account that the representation has only been disposed of vide the Speaking Order dated 30.07.2026 which is kept on record and marked with the letter “X”, the dispute as regards the entitlement of the Page No.# 4/4 interest would be deemed to have arisen only on the date on which the Speaking Order has been passed.
