Issue an order or direction or writ in the nature of writ of certiorari quashing the Order No.JiPamAa:PMAY/Ta.No.Aa.Bi/2025-26 dated 30.08.2025 marked at Annexure-E issued by the 2nd respondent. ii. Issue an order or direction or writ in the nature of writ of certiorari mandamus directing the respondents, more particularly the 2nd respondent herein to continue the petitioner at the present place i.e., Arasikere Taluk Panchayath, as Taluk Nodal Officer. iii. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. A perusal of the material on record will indicate that the petitioner was working as a Taluk Nodal Officer in respondent No.2 on 30.08.2025 when respondent No.2 passed the impugned order at Annexure-E dated 30.08.2025 relieving the petitioner from service. Aggrieved by which, the petitioner is before this Court by way of the present petition. 4. As can be seen from the aforesaid impugned order, the respondent purports to place reliance upon a report of the Executive Officer without providing a copy of the same to the petitioner nor providing sufficient or reasonable opportunity to the petitioner or hearing him thereby violating principles of natural justice. - 5 - HC-KAR NC: 2026:KHC:22494 WP No. 28774 of 2025 6. Per contra, learned counsel for respondent Nos.2 and 3 - Panchayath submits that there is no merit in the petition and the same is liable to be dismissed. 7. A perusal of the impugned order will clearly indicate that the same has been passed in contravention of principles of natural justice and without providing sufficient and reasonable opportunity to the petitioner and in order to provide one more opportunity to the petitioner, I deem it just and appropriate to set aside the impugned order and remit the matter back to the respondent for reconsideration afresh in accordance with law by issuing certain directions. 8. In the result, I pass the following: ORDER i) The Petition is hereby allowed; ii) The impugned order dated 30.08.2025 at Annexure- E is hereby set aside. - 6 - HC-KAR NC: 2026:KHC:22494 WP No. 28774 of 2025 iii) The matter is remitted back to concerned respondent Nos.2 and 3 for reconsideration afresh in accordance with law. iv) Liberty is reserved in favour of the petitioner to file its reply, pleadings, documents, etc., before the respondent, who shall consider the same and pass appropriate orders in accordance with law. vi) All rival contentions on all aspects of the matter are kept/left open and no opinion is expressed on merits/demerits of the rival contentions.
