Heard Mr. S. Borthakur, learned Senior assisted by Mr. S. Dey, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State.

This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, namely, Dulal Boro, has prayed for granting pre-arrest bail, apprehending arrest in connection with Goalpara P.S. Case No. 113/2026 under Section 143(3)/144(2)/61(2) of BNS, 2023 read with Section 3/4 of the
Page No.# 2/3 Immoral Traffic (Prevention) Act, 1956.

The gist of accusation in this case is that on 29.06.2026, one Nabajyoti Dha and 11 others filed an FIR before the Officer-in-charge of Goalpara police station inter alia alleging that on coming to know that immoral activities are carried out in Rajmahal Hotel situated at Bapuji Nagar, Goalpara, a raid was made in the said hotel at about 11'O clock on 29.06.2026 and during that raid, boys and girls engaged in immoral activities in Room No. 101/102 and 103 of the said hotel were caught red handed.
4. It is submitted that by order dated 07.07.2026 in AB 1531/2026 co- accused, owner of the hotel, Habil Uddin Khan has been granted the privilege of pre-arrest bail which was subsequently made absolute by
order dated 24.07.2026.
5. In the instant case the petitioner is the manager of the said hotel who was arrested on 30.06.2026 and now has been 35 days in custody.
6. Having regard to the above as well as the period of detention and the nature of the allegation, further detention of the petitioner may not be necessary. Accordingly, it is provided that the petitioner, named above, in connection with above mentioned case, they shall be released on furnishing bail bond of Rs.50,000/- with a two suitable sureties of the like amount, to the satisfaction of the arresting authority. The direction for bail is subject to the conditions that the petitioner: (a) Shall co-operate with the remaining investigation;

7. Accordingly, this bail application stands allowed and disposed of.
