Heard both the sides. This bail application has been filed on behalf of Chandan Kumar who is in custody since 08.09.2025 in connection with Barhi P.S. Case No. 315 of 2025 for the offence registered under Sections 69, 316(2) and 318(4) of BNS, pending in the Court of learned S.D.J.M., Hazaribagh is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that the victim girl is a major, aged about 22 years. The incidence is alleged to have taken place way back in 2022, whereas the case was lodged after about three years in 2025. It is further argued that the delay in lodging the FIR discounts allegation that cohabitation took place on a false promise of marriage. Learned A.P.P. for the State opposed the prayer for bail and submitted that the delay occurred because of panchayat was held in which he had promised to marry the victim girl. Under the aforesaid facts and circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
