Per contra, learned Public Prosecutor has vehemently opposed the bail application. This Court has considered the arguments advanced by
learned counsel for the petitioner and finds that the alleged contraband 4 kg 245 grams poppy straw has been recovered and the same has been recovered from the backyard of the petitioners and not from the conscious possession of the petitioners which is below commercial quantity. There are no criminal antecedents against the petitioners and the petitioners are behind the bars since 19.06.2026. Hence, keeping in view the overall facts and circumstances of the case; conclusion of the trial of the case is likely to take time; the narcotic contraband recovered is below commercial quantity; the prosecution has not shown any apprehension of the petitioners fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. Accordingly, this bail application filed under Section 483 of BNSS is allowed and it is directed that petitioners – Bhura Ram S/o Hetram and Vikas S/o Bhura Ram, shall be released on bail in connection with aforesaid FIR, if not wanted in any other case, provided they executes a personal bond in the sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/-
